If it 'grabs' files, then it would be technically possible to read the source file from which the image on the .swf file is taken, since it's on the server. Thanks for the info.

if you don't store the .fla file on the server, there should be no reference to the image file with the .swf file.. Or if you elect to store the .fla file on the server you can simply store it in a seperate directory, and password protect it, so no bots including picscout could access it..

Ah "rights managed".

I'm going to reply to their email (second threat), but I'm a little hesitant as to how to tell them to go F themselves. I've been reading the information on this site (great site by the way) and I'm figuring I'll get back to them next week with a "fair" ($40) offer and a caveat of not admitting anything.

Personally I would not reply to any emails from them, let those cheap bastards spend a few cents on a stamp...as for the nice way to tell the to go F themselves perhaps something like this would work..

Does anybody know how long it takes to hear back from Oscar or his staff?  I emailed two weeks ago, and again on Monday July 8th, but haven't heard back about how to pay.  I sent my email to [email protected] according to what I read by attaching a pdf of the Getty Extortion Letter I received, but haven't heard anything.  I don't want to contact again, because I don't want to seem impatient.... (maybe I am..  lol), but I'm just not sure how long it usually takes or if possibly I'm not going to be able to participate.

Perhaps I'm approaching it wrong.  I don't need to talk with Oscar or staff (unless he needs to talk with me), and I don't need any free time with anyone. I just want to know how to pay, and if they will do it for me.  Anyone?

My wife just received an extortion letter from Craig B. Sanders of Sanders Law, PLLC representing the National Photo Group, LLC regarding an image on her fashion blog.  Didn't see them on the list so I figure they are new to the party.

Looks like we have a few days of research ahead of us.

I'm new to being threatened by MF. I guess I'm not a virgin anymore. ;)  Anyway my story is too much like everyone else's to bother everyone with it. Except that the image wasn't even accessible from the links in the site, the page it was on had no links to it. 

But I do have a question. How can the MFers try to charge $3,880 for "retroactive use" of 1 image, when according to their website the going rate for a single image is $10 to $40 depending on size?

Heres my best guess....the images ranging from 10 - 40 are "royalty free" and the image they are accusing you of using is "rights managed" which is more expensive.. in their eyes anyway

This program that Getty is using to scour the 'net to look for pictures, can it 'read' images that are part of a Flash display in an .swf file?

I have not seen this firsthand, but I believe there was a thread at some time involving Getty and  a flash driven site. As far as I know Picscout grabs jpg, gifs, png, and pdf files and then compares them to Getty's library..Picscout makes plenty of real dumb mistakes, but I also think someone may review any postive results, before sending it along to the college intern, so called "copyright specialists"

Actually, I'm impressed that anything could find such an obscure part of my web site! I doubt that many of my clients even found that page.

Getty's Picscout bot rummages thru every directory, pulling and comparing images...eating up loads of bandwidth looking for alledged infringements...

Chances are very slim they will file over 1 image, if they did it would need to be in federal court where you are located.

I'll take  a stab at their reply: "This image is "Rights Managed" and a licence must be purchased for each use" or something along those lines. I " think" (I'm no lawyer either) if there were some commentary along with the image, one "might" be able to argue fair use in this instance..
