Agreed.  I knew we were headed towards this point over 15 years ago when I was looking to purchase a hydraulic log splitter, there was a warning label on it stating “Warning: DO NOT Place Head Between Block and Ram!  Serious Injury or Death May Result!”  I have never forgot seeing this and I laughed at it, the salesman asked what I was laughing at and I pointed to the sticker and was told that the sticker was a result of a lawsuit.

This is definitely one of the major things wrong with our legal system.

I just found this story in this kind of thing makes me so mad I get sick to my stomach. The small town of Miami Oklahoma had a company in it called Blitz which manufactured 75% of the gas cans we buy to store fuel for our lawnmowers and cars. At one point they employed over 350 people in the small town. Several years ago they started getting lawsuits claiming that their gas cans were exploding causing harm to people. They were told that the cans were exploding while pouring gasoline on an open flame to either accelerate or start a fire. The number of these lawsuits increased to the point where they were actually defending themselves against 40 cases and the cost of legal fees and increased insurance bankrupted the company. According to the documentary not only did Blitz USA have to pay to defend themselves from these frivolous lawsuits but they actually lost some of them due to jury members seeing plaintiffs disfigured from gasoline burns and feeling sorry for them and awarding them money.

One of the things in the documentary that really bothered me was that on the day the company was closing there was a meeting in Chicago of lawyers where one of the rooms at the event was to teach lawyers specifically how to sue companies like Blitz USA. In my opinion lawyers like this are as bad as the trolls and give good and honest lawyers a bad name.

From what I understand is the company went through bankruptcy and its assets were put up for auction, it was acquired by a Canadian company which will resume limited production but does not seem to be offering former employees their jobs back.

Here's a post I made in my Experiement Against Getty thread using cranky fish's Court Opinion he posted, you all may want to include this bit in any repiels to Mustoe.

While reading the posts in another thread I came across something I thought was very interesting. A post by cranky fish where he cited a Federal District Court opinion on a case contain something I thought was interesting. While citing the history and the facts of the case the court made a reference to the "Extortion Letter" that was initially sent out and made this comment about it.

This Court must be very careful to treat all attorneys with courtesy and not launch missiles. The Court, however, finds a portion of the letter from the Kansas attorney to be frankly disturbing. No person, especially an attorney, should be even mentioning a possible criminal prosecution in an attempt to collect money in a civil dispute. Extortion is theft by threat if a person obtains property of another by threatening to accuse anyone of a criminal offense. This is not only the common law but is a statute in South Dakota. See SDCL 22-30A-4(2). It is also a specific grounds for disbarment in South Dakota.

I would like to thank cranky fish for posting this district court's opinion as I am going to modify all of my complaint letters I have ready and waiting should I receive a letter from Mr. McCormack and also the complaint letters I have ready to go against Getty images and Lisa Wilmer to include this Federal District Court opinion.

For those of you who are writing complaint letters I would recommend including this in your letter in some fashion and here is the link to the entire opinion provided by cranky fish.

I have also included the fact that Mr. McCormack references cases that have no relevance to the Demand Letter to try and scare people with fear of huge court judgments against them and include a copy of Oscar’s beautiful letter to Mr. McCormack.

Great catch Greg!!! Seattle attorney Timothy B. McCormack would probably shit a brick, if this little snipper was included in a complaint the the 3 bars he's admitted too...

Robert is correct, don’t panic and get educated.  I find it pretty amazing that MasterFail will make a $6640 discount in one shot.  They might have a hard time proving the value of their images (Which we all know are not worth more than 25 bucks tops) when they make such a drastic discount.  Remember they use fear of escalated actions; emanate lawsuit and artificial deadlines to panic you in to paying them before you have a chance to realize you are rolled.  Only the government would pay $700 for a hammer and think it’s a good deal so don’t pay 2000 grand for a picture!  However MasterFail is more aggressive than Getty so you may wish to use Oscar’s letter program. Welcome to the forums Cranky Fish.  I suggest that you start by reading the forums as they contain a wealth of information you can use to defend yourself from these copyright trolls.   I have found that a complaint letter writing campaign worked well for me and has made Getty Images back off and leave me alone.  I have detailed what I have done along with all correspondence between Getty and myself as well as all complaint letters and responses and made them available in this thread.

I would start reading and ask questions if there is anything you don’t understand or specific information you are looking for but have not been able to find.
