It seems like all of those llama slideshows might be coming back to bite BuzzFeed.
The website, which is known for aggregating images from other sources, is being sued by a professional photographer whose photo was used in a typical BuzzFeed post called “The 30 Funniest Header Faces.”
The Guardian:
His picture of a grimacing player was removed from the article – now titled “The 29 Funniest Header Faces” – after he made an initial complaint in May 2011.
But in a lawsuit filed in New York, Eiselein accused Buzzfeed of “direct and contributory infringement” and claims he is owed $3.6m after his work was shared widely across the web.

Getty has only filed 1 case against a single image infringement, and believe me it was a handpicked case, one they knew would quickly settle, and one they knew would not go the distance...Chances are very good they will not file in your case, and in my opinion the odds are even better with oscar on your side..he has handled over 800 of these letters and not a single one resulted in a lawsuit. It's 200.00 well spent for the peace of mind and keeping your client happy!

Yup, that's the one, old Cindy Hsu didn't last long in the trolling business, I think it was about 2 weeks after we posted and reported on this, that she apparently closed her office severed ties with the Queen of trolling Carolyn Wright and headed off to China...

Lets also not forget the case of the scented trees, where Getty was sued for Trademark infringement, perhaps Nikon will follow suit.

Imagine that Getty Images collecting on images they don't even own! amazing!! I'm out of town, but when I return, I will be posting a court complaint where Getty images is the defendant, and yup for copyright infringement! and this is not the only case.. Getty images doesn't care if what they license is theirs, they don't care if the images you use are theirs or not, it's all about money, and innocents giving it to them. Not to mention the fact that getty has also been busted red handed, moving "royalty free" images into the "rights managed" catalog, without telling the contributors and also then sending out extortion letters for these so called "rights managed" images and jacking up the demand amounts.....Doucebags the whole lot of them including Seattle copyright attorney Timothy B McCormack, and that other disgusting troll Carolyn Wright aka "photoattorney" along with Leslie Burns, who are known around these parts as sending out the highest demand letters we have ever seen...

chances are good they will continue to harass you whether you ignore it or address it. I personally would address it and politely ( or not so politely) inform them that the image in question never resided on your servers, there fore no infringement occured, reference the perfect10 v google case, and also mention that the thread in question was removed over 2 yrs ago.. you might want to include that if they continue to harass you ,you will not only invoice them for your time, but that you will also consider lodging complaints with the washingston state attorney general..

Do you have a registered agent, and DMCA information clearly visiible on your site? If not that would explain why you hot no notices, and if you don't have a registered agent you would not be covered by the safe harbor that DMCA affords... as for the images in question, if they were "linked" to in the forum thread and not ever uploaded to your servers, then there was no infringment, and Getty Images knows this..refer to perfect10 v google...hotlinking images is not an infringement as no "copy" has been made..

So, in essence, to be safe I should only use images I have created from scratch and copyrighted ... or get out of the web design arena and let someone else have the worry. What a world. Even if you pay for an image, you can't be guaranteed safe use? I remember when artists couldn't wait to get exposure for their works. Now, it's just a greedy racket.

Not what I said.. You only use images you create, or purchase images, and keep records of everything, and be sure to read and understand the terms of use.. Getting out of the web arena is completley your choice, I never suggested such..and I'm not getting out because of some greedy trolls, by them pursuing me has cost them dozens of customers that will never purchase from them.

I was interested in 123rf's "free" images, from their TOS / EULA:

The bolded areas were highlighted by me...yup the images are indeed "FREE", but you use that at your own risk, if they infringe it's your problem, and it is probably a good idea to "seek competent council" before using any content......

3yrs is the statute of limitations, after this they cannot file suit..
