I'm kindof like the pot calling the kettle black.  In my last post, I meant to spell "shit" but it came out "pig".  Cheech and Chong will hate me for ruining one of their bits.



I am pretty sure that "smuggling drugs across state lines" anytime, violates the Seattle Supreme Court code of conduct for attorneys and may be grounds for disbarment - in case anyone wants to put Seattle attorney Timothy B. McCormack out of his misery - career-wise.

If that is the current incarnation of the "Getty Letter", I will say this for them.

They have certainly cleaned up their administrivia.  Four years ago, when I received my letter, it was full of typos, absurd claims of what the courts might do, and collections language that made them look like a Nigerian oil minister scam.  At that time the letter looked like a scare tactic comparable to UFO abduction articles in tabloids.

Oh wait, my letter never came from Getty.  It came from the so called attorneys at McCormack IP Law.  My mistake.  Maybe Getty has always practiced their little game with good grammar and a minimum of hyperbole.  Maybe it was just their first level counsel that couldn't do the grammar thing.

As my friend Robert might say, "If it looks like a pig, and it smells like a pig, and it tastes like a pig, good thing we didn't step in it."  The Getty letter might look and smell better than the four year old McCormack letter, but please don't step in it.

For the three year Statute of Limitations, the date of infringement is the earliest date the infringement is discovered by the infringed party.  In your example, if you were notified last week, the earliest date of infringement you can prove, is the date you were notified.  Obviously, they would have known for some period of time prior to that.

  So Stern & Schurin who contacted my company does not even represent stockfood america.
According to the Digital Millenium Copyright Act, the only person or entity who can sue you for copyright infringement is the copyright holder.  These rights can be transferred in whole to one entity, but the above quote leads me to believe that has not happened.  It leads me to believe that they pay License Compliance Services to harass people to give them money under threat of the law (trolling).

I agree with Jerry's highly unlikely scenario.

Take this for what it is worth.  I am just a guy who has been watching these copyright trolls for about 4 years now and that is what I would read (between the lines).

I agree with luanne415.  They are not likely to file.  But you will have to deal with the aggravation for 3 years from their first discovery.

My advice - read as much of this forum as you can absorb.  It will give you more options you may not have considered. But more importantly, it will give you peace of mind in whatever decision you ultimately make.

My advice part ll - don't give in to their scam by paying them.

The lovely Miss Irina likely is simply fishing for easy marks.  She does not expect to catch everyone, and is likely expecting her success to be as rare as a prize trophy fish jumping into her boat. 

Although it really doesn't add any value to society, I would rather see people wasting their time like her than play the trolling game. 

What I dislike about Getty, picsout, and the new myriad of company names under which they allegedly practice their trolling game, is that they pretend they really have a case.  They waste the time of innocent letter recipients (some may be guilty and deserve to have their time wasted) without properly vetting the cases first.  They cause angst, fear, anxiety, and health problems for innocent people which ultimately subtracts value from society.

They should have to pay a price each and every time they make an accusation and threat that is actually unfounded. 

Miss Irina is easy to ignore.  And she expects to be ignored.

FYI, in most cases, Getty is NOT the exclusive license holder.

I am not a lawyer, but there is case law out there indicating that hot linking is NOT copyright infringement.

I would make them aware of this once, in writing, return receipt requested. 

I believe Atradius is a collections agency.  I might also inform them that there is NO debt here and that they may have been mislead by their client, but let them know that you will rigorously defend your rights and good name, should they persist.

Very common, because smart people stall by not responding to emails.

That First Notice thing is a nice touch too.  It feeds into the theme that there is a process they go through before bringing in the next step.  It can be very intimidating - if you let it.

I hope this slows down Getty and their clients or sub companies.  Perhaps if they have to review things before sending out their picscout generated letters, it will raise the cost of doing business for them.

If they choose not to review things before sending out letters, I hope this forum's readers stick it to them good.
