I have my letters all ready to go but Mr. McCormack hasn't sent me a letter so I can't file my complaints against him and Lisa Wilmer. :(

Merry Christmas Mr. McCormack

So now you're a bus driver (under Avatar)  Is this the bus you are going to use to back over Trolls with? ;D

@Peeved

I always try to have a sense of humor :D

Nice to see that Greg has a great sense of humor with regard to "Mr. Non-Credible"'s remark! (See change below avatar). Btw...I am officially protesting to the change!
 :P

Well aren't we observant....

I believe in keeping my eyes and ears open and seizing any opportunity that presents itself.  If I see that there is a hearing on one of these issues I have gathered quite a bit of information that I am prepared to have delivered which might help show what Getty and their ilk are doing with their business model.  I am not sure what I would/could if it is sweeping reform but if that were the case the EFF would most likely be involved and I would see about getting information to them or asking them what if anything they need to help them out.

There is a lot of really good information over at the EFF site, I highly recommend visiting there at least once a week, I stop by at least every other day.  www.eff.org

I would let them know that you have nothing further to discuss unless proof of claim is provided and if you hear from them again you will file complaints against Getty and the shyster with the Washington State Attorney's General Office, the BBB, the FTC your Congressman and Senator as well as the Bar Association for the Shyster and Lisa Wilmer (Getty's legal beagle).

And very quickly too :)

Thanks Robert..I am now using pacer also..Does it show suits that are newly filed. Even if plaintiff has not been served..

Yes it does, but be warned, if you are not careful or diligent, it WILL get expensive!

Thanks for the explanation on how Pinterest works thanks for the explanation on how Pinterest works as well as the link to the Plagiarism Today article. Yes, it appears the way Pinterest is currently set up the and users are on the hook to the trolls. It seems they could've accomplished pretty much the same thing and keep everybody happy as well as safe by linking back to the image. I can see Pinterest becoming the next troll battleground.

Mulligan, I get a 403 Forbidden when I click the link.

Greg, some images I pinned for a client were saved like this...

Is this a field of easy pickings for the copyright trolls?

I remember SG talking about Pinterest trying to block PicScout awhile back, it is in my file of stories I wanted to watch and follow up on.  That list is getting way to big :)  I have wondered about pinterest for a while now, I do not use it.  Can anyone tell me when you "Pin" images are you copying it to your board or are you just linking it like here on the forums?  If the images are just linked I don't think the people who pin have much to worry about.  If the links are traced back to the people where the images are linked from that could be another matter…

There does not appear to be any new suits filed by Vincent K Tylor, but it just dawned on me after re-reading my post that copyright troll Vincent K Tylor is teaching his son the ways of trolling.. His images also appear on FREE wallpaper sites.. I'm going to try to confirm whether or not Glen Carner of Hawaiian Art Network and Vincent K Tylor have gone separate ways. I hope this poster from FB visits the forum and shares her letter with us to shed more light on this..

Also we have a mention of Pinterest, knew it was just a matter of time, it's gonna be open season before long.

I found a great article over on the EFF website. The EFF wants Congress to review the current copyright law is and make changes to it and it looks like a report was issued by the Republican study committee which was quashed and withdrawn due to pressure from the copyright industry.

Quote
Last month, when Derek Khanna—a staffer for an influential policy group called the Republican Study Committee (RSC)—put forward a report busting some persistent myths about copyright, he wasn't met with a real debate or with fact-checking. Within a day his employer, reportedly under pressure from legislators supported by major copyright industries, retracted the report. Within two weeks, Khanna was told he would no longer have a job with the RSC.

It is a very good article and I highly recommend reading it but it certainly shows we have a major uphill battle in our fight. The entire article may be read here:

I tend to agree with Jerry on this.  I run a remodeling business and my estimates look like small books sometimes as I have learned that you have to spell out exactly what you are doing, what you are not don't, what materials you are providing and what the customer must provide or  I find that so many things are discussed the customer can't always remember everything.  No fault of the customer as you are often explaining things they don't fully understand and covering a lot of information, I do however think that it would help if the web designer notes this on the estimate/invoice.  I have learned to do this from experience and found that a little CYA goes a long way.

Good article, thanks for sharing Robert!

Looks like Avepoint dropped the case, don't know why. That's the part that always bugs me; I wish it would state the reason so I could know if Getty settled with them out of court or what.

Thanks Robert, it was an easy find in PACER.  I was uploading to SCRIBD when you replied.  I know what you mean, you type in what you are looking for and you get other hits that look interesting, $0.10 a page can add up fast considering the size of some of these documents.  Got to love PACER though....just sayin :)

I would imagine the avepoint stuff would be in Pacer....Greg if you don't get it I'll go for a look tomorrow...been trying to stay away from pace..I tend to wander to much in there and it gets costly...

I have read those and actually keep a link to it in my folder of cases I like and can use in my fight.  I recommend it to everyone, thanks for sharing the link Mulligan!

Robert, thanks. I recall reading that when you or Matt first added it to the ELI collection. I would be interested in knowing the outcome myself.

I've turned to the declaratory judgment option after reading how successful the folks at Tabberone.com have been using that strategy to fend off large companies that have tried to stop their eBay auctions. You can read a sample of the suit they filed that caused Disney (!) to capitulate at:

http://www.tabberone.com/Trademarks/DisneyLawsuit/ourlawsuit/complaint.html

The entire story of Tabberone vs Disney is at

http://www.tabberone.com/Trademarks/DisneyLawsuit/DisneyLawsuit.shtml

Fascinating reading at both urls.

Greg, you'll love reading the above. :)
