Generally, it is better to  make some offer so that if it ever gets to court you can at least state that you tried to resolve it, but both Matthew and Lettered are correct that Getty will not accept it. They will likely send your claim to NCS Recovery, their collection agency. So your idea is not a bad one, but it will not make the issue go away.

As always, Lettered, great info.  We have long been advocating taking your own photos for your sites.  Even hiring a professional photographer to take some shots for you (get a release as to the ownership) is cheaper than facing these claims or having to worry about it.

You should look in to a settlement Masterfile did in Idaho with Template Monster.  They may have resolved it and not be allowed to proceed any further with the claim.

Dear Rod:

Canadian Copyright is generally very similar to American copyright law, but I have not summarized it for the site nor do I feel comfortable doing so. If your company is out of business I would not overly worry about it.  Getty is also not likley to sue a defunct corporation over three images.  I leave it to Matthew to commment on the generic letter issue.

You ignore Masterfile at your  own peril. I don't know who has been advising you to ignore this claim as "a high sales pressure tactic," but it certainly is not what is recommended on this site. That term may fit Getty's Letter Demand Program, but it does not apply to Masterfile, for reasons sets forth in numerous prior posts and topics on this issue on this site.  As you see from the Brooks Cycling Tour case, Masterfile was awarded $1,100 in damages and about $6,000 in legal fees - $7,000 for one infringement in that case, so clearly they cannot be ignored.  I will be in the office tomorrow after 2PM NY time if you would like my advice on how to proceed. 516 248 8000. It is difficult top search for this on your own, but if you ask Masterfile in writing for the registration information they are likely to provide it to you.  Unlike Getty, Masterfile almost always registers its images, normally in compilations of several hundred images. I doubt it was registered though back in 2001 as I think they began registration around the time they started using PicScout (2005 or so). At least those are the oldest registrations I have seen in my 30 or so Masterfile cases. You mayhave bought that image even before Masterfile owned it. Keep us posted and let us know what you find out.
