don't send that letter, read the forums, get educated first.....it's not a good idea to "plead guilty" in your letter...it is up to them to prove you are guilty..

Perhaps an easier way to audit, would be to reference all images you have license and reciepts for, those that you don't could become an issue down the road..I guess it all depends on how many sites and images you're looking at.

don't call them, don't make it easy on them in anyway..

your statement "I have tried to ensure to a high degree that images used on my site were in the public domain and free to use." concerns me.. there are very few images in the public domain worth using...most of these would come from government sites or be very old.. I hope you are not confusing "public domain" with "royalty free"...2 completely different beasts, not to mention that "royalty free" does not mean "FREE"..

FYI, it's not required that images have a copyright notice, or watermark or anything, always assume that if you did create the image, someone else did and it's copyrighted.. copyright exists the moment of creation.

as an fyi, the statute of limitations is 3 years from the date they discovered the image, if you got the first letter 2 years ago, you're well on your way to the end of this..at this point if it were me I would probably not respond and wait it out..but that is a decision only you can make.

Hi everyone.
Well ... here I find myself once again returning to this great forum. As you can tell from the dates of all our last postings, it has been some time now.
However, I woke up this morning to find a new email from NCS now ... so my question is should I respond to them one final time - outlining all that I wrote to Getty back in July/August (i.e. the sample letters I showed you all back then & my "defense"), or should I completely ignore them?
Thanks everyone for the input. Here I thought I was "in the clear" ... but obviously not lol!

Respond to them by stating this is a "claim" not a debt and they have no right to contact you. Further that by letting them know if they continue to harass you, you will report them in accordance with the fair debt collection act ( or whatever its called)... poke around the forum, there are threads dealing with this and ncs.

It's not up to you to prove anything, it's up to them to prove you did....remember this is America..innocent until proven guilty...

If you haven't had your dose of nutty legal claims of late, Adam Steinbaugh alerts us to the latest in the long and ongoing saga of our buddy Charles Carreon. When we last checked in on Carreon, he had more or less admitted that his legal threats against a satirical blogger making fun of him were baseless, and had voluntarily agreed to "settle" the case. In that effort, Carreon ignored the issue of legal fees, so the lawyers for the blogger -- Paul Levy and Cathy Gellis (disclosure: I know both of them and consider them friends, and Levy has acted as our legal representative on multiple occasions, so take any analysis with however many grains of salt you'd like) -- sought legal fees. Carreon went on a bizarre rant against Levy in his filing for an extension, trying to build up some conspiracy theory involving Levy somehow trolling the internet for people like himself to go after.

Surprisingly this list does not contain ISTOCKPHOTO.COM, which I understand is owned by Getty Images as well.

good catch jerry, the reason it did not appear in the above list, was I was doing some IP address research.. all of the above domains are actually hosted with the Getty office's.
