Getty Images Letter Forum / Do the photographers know this is happening?

From what I have read on these forums, the central defence against the getty letter goes like this:

 a) The photographer owns the copyright on the image
 b) Therefore ask to see proof of Gettys exclusive right to enforce copyright on behalf of the photographer

Is this correct?

If so, I wonder if the photographers know what getty are doing "on their behalf"?  The name of the photographer that owns the copyright of the image we used was included in the letter, and I found myself wondering if he would support getty's action?

Is there any point in organising a campaign to make the photographers aware of what getty are doing, thereby causing them to have second thoughts about selling their images through them?

Just some idle thoughts - thanks for listening!

Thank you both.  I agree defending in the manner you suggested is the best use of time, I'm just checking if what the bottom line it.  I feel better knowing there is this safety net :)

Hi all, so on Friday we got the letter.  I've been reading up on it since, on this forum and others.  One thing that strikes me is whether the Getty case can hold up in court, so I wanted to see what others' opinions are.

Getty send a snapshot of the site at a particular time.  We took down the image immediately, so now that page cannot be reproduced i.e. nobody can view it and say "look, there is the image".  Even the wayback machine does not store images, just references to images, so once we delete it from the server, the page cannot be viewed as it was.  I'm sure the same applies for google cache.  There may be other page copying sites that I am not aware of though.

So, Getty's snapshot proves nothing as far as I can see, as it could be fabricated.

Am I misguided?
