Luanne- how much were they originally seeking ? what was your strategy?? Going dark,, Oscar.. ??

One was originally for over $500 then reduced to $400+, now it's at $382 (it fluctuates and changes just like the wind based on whatever they feel like) and the other is for $478 (the case they closed).

1) My strategy was being upfront and calling them out the moment I got the email because I was appalled at their business practices from the start (this was before I discovered this forum and the thousands of others experiencing the same thing).

2) Once I did some digging, I took it further and wrote a full blog post on the situation. They are outright bullies and trolls and I would rather go out in flames than cower in fear from these asshats.

Who knows why but Troll McGee aka Trunk Archive aka LCS aka Getty decided that I'm not a worthwhile pursuit after sending me a couple of letters since August 2015.

Perhaps they'll read my blog post and close my other case too. Either way, whatever :)

Personally I would ignore it. Just filing a complaint in a California court alone is around $600. Based on that info alone, this is just a scare tactic. They are just bullies. That's my opinion however. I wrote a post about it a few months back to share my experience.

We, at ELI, are much pragmatic people.  We like to take meaningful action.  Signing an online petition requires little effort but it also has little impact in making a difference.

Many of the strategies discussed on this forum such as filing complaints to certain agencies are very powerful and effective. Speaking out public and sharing information here on the forums is very powerful on so many levels.

The Google and Bing search engines are our friend. When people post on these forums, it also helps us out in getting the word out within search engines. It is amazing how education and knowledge to many people can effect so much change.

People who hang on ELI are not about cowering and hiding.  It is about being smart, creative, and punching back.  Everyone gets to choose how to punch back directly or indirectly.

Just know that if you are "only" reading, lurking, going dark by not paying, hiring me or Oscar, you ultimately are punching back. Filing complaints, outing extortionists, and naming names are all awesome gravy items.

It is difficult for anyone who connects and reads ELI to NOT have a negative impact against copyright extortionists.  It is how we roll around here.

Here is my contribution to the Getty trolls. It's a very well search engine optimized blog that's been around since 2007 ;D

If you wrote it and did it, then you gotta own it. It's just too bad for the troll  ::)

Nice blog post, however I tend to agree with Robert.  August Images are a different animal entirely from Getty. August offers celebrity photos which are high quality and professionally taken.  Artist's tend to make sure these images have all their i's dotted and t's crossed when it comes to the paper work end.  This does not means they will come after you but you may want to take their letters more seriously than you would a Getty or McCormack letter.

Based on my research, the celebrity photo in question cost between $1.06 for a small image to $39.00 for a full sized image.

Since the image I'm "in violation" is a little bigger than a thumbnail 176x176px, I am offering $15 as a settlement for a one years license. My site has not even been up for year so as far as time and fair market value goes, my offer is a totally fair and reasonable number.

Problem here is that when the trolls do read this, you've admitted grabbing the image and using it ( this will be used to bolster ALSo the address of Picscout a company Getty owns and uses to discover these infringing images, the letter comes from Picscout on behalf of August images.. the good thing here is Picscout does NOT have the ability to file suit, that would be totallty on August Images IF they indeed own the copyright, which they may not, they may only have the right to license the image. Simply because there are many images showing up in an image search without a watermakr doesn't mean it is open season on these images...hell my street alone has cars parked all over it without names, but I can't just go take one...this is where so many people get tripped up..there is nothing for free in this world plain and simple.. I would be suspect to any site that offer "FREE" images.

I agree and frankly have no issues admitting I did use an image.  What I want to highlight is Getty Image's ridiculous extortion through inflated prices. $510 for a thumbnail when I can get it for less than $14 somewhere else?

I could have asked Alicia Silverstone's assistant for a pic of her directly but did not want to bother her with such a small thing.

My point is to highlight a fair market value of images and to showcase just how desperate Getty Images is by a) Trolling and extortion and b) Putting ridiculous prices on their images.
