Getty Outrageous prices  - Getty New Strategy

After getty bought picscouts, getty raised the prices per license/photo
In 2008 - 2010, the price per license/photo was , $20 - $50 ,
In 2012, the price of the same license/photo is $ 500- $1000

Getty has always gone after "actual damages" since they don't register their images (and therefore cannot get statutory damages) Their pricing regimen is one thing, how often they sell them at those prices is another and what the fair market value of the image is a third!
Anyone receiving a demand should also insist on seeing the pricing history for that image before trying to settle for these outrageous numbers.
Historically, they NEVER sued for one image.

When you tell them to "cease all communications". This is the date when getty become legally liable to you. You do not have to wait 3 years.
If they still communicate with you, file a police report in seattle and file a complaint with the FBI to make your complaint part of the "Public Records" ;  you and many other  government agencies will have access and able to use these public records.

You are considered innocent until proven guilty in a court of law. For the last 5-6 years, getty made thousands of claims. These are claims only. Being accused , and making claims of something you did not do, for 3 years, is considered harassmenrt.
File a report with the police even if they do nothing in the beginning, you at least have a report on file.
Later, the Police must act, when the number of reports pile up from you and others.

In your response, tell them that the images were removed, and without admitting any guilt, send them a fair offer that you can afford. Always tell them, they or anyone they retain in the future need to cease "all types of communication with you"   if they do not provide you with what you are asking for.
Have you made a checklist of things you are going to ask for? These should include at least:
Proof of copyright registration.
Proof whoever is contacting you has an exclusive license.
And so on?
Tell them if they do not cease all types of communications, you will file a police report , and file one if they do not respect your request, it takes just a phone call. Everytime they do not respect your request, and If they keep sending you letters / emails, or someone they retained send you letters / emails, keep filing police reports one after the other .

When they don't provide you any proof, and you tell them to "cease all communications", this is the date when getty become legally liable to you. You do not have to wait 3 years.


Also ,  getty, ncs, mccormack, are using emails for communication.
These are unwanted emails, and they are regulated by the FCC

if a request is made to getty , mcormack, ncs, to  "cease  all communications"  about the settlement, should they legally stop communicating ?
 
If you tell a person or business, in writing, that their business or anyone they retain to represent them need  to “cease communication” regarding their claim,  and they continue to contact you, harasse you, you have the right to contact  the police department where that person or business are located, speak to a detective, and file a police report.
The detectives will contact that business and inform them not to contact you anymore. You do not need to suffer for 3 years. This is the date when getty become legally liable to you.
NCS and McCormack are retained by GETTY, so Getty is still the entity responsible for ALL communications. You need to contact the police department where Getty is located.
