There's a difference between an intention to file and actually getting a complaint and summons that was filed in federal court.  Higbee likes to send a fake complaint that states the suit and the particulars of what they allege you did.  Is that what you got?  If so, it's just another scare tactic.

That's exactly the way Higbee wants you to feel.  I totally understand.  But this to will pass as the days go by.  Courage and strength comes with knowledge.

I suggest you edit your original post and remove reference to the nick name of your website.  There's no need to put that out there.  Second, I would strongly suggest not following the advice of your lawyer acquaintance at this time and enter in communications with Higbee.  Not that the advice isn't legit but it's for a latter time if a suit was actually filed against you.  Keep a file on what Higbee sends you and go on living your life like you were doing before.  In the meantime read this forum and learn from others who have dealt with this.  You are one of thousands if not more dealing with this scam.  You were on the right track all along.

If you're going to go the negotiation route I'd give them a once time take or leave it offer of what you think that image is worth.  They're going to reject any offer you make that isn't $2,500.  Then it becomes a matter for your stomach.  Showing vulnerability is the worst possible thing you can do.

I'm not sure what your saying.  But, there no short cut answer.  You have to educate yourself to what's happening and this forum is a good place to start and it has a wealth of information.  My advice to you is not respond to any firther communication.  Don't be so quick to see a lawyer unless you were served with a summons and complaint that was filed in court.

I agree with Robert.  Responding to Higbee was a mistake.  You've said and done too mucj already.  But, since you made an offer I don't see no reason for further communication.  Understand this Higbee is looking to make money off of low hanging fruit.  Stop all communication.  An offer was made and reject so now it's time to go silent.  If he files it's not the emnd of the world.  Filing an answer to a lawsuit is not reckett science, you can do it yourself.

This case involves a blogger that was sued by photographer Christopher Sadowski represented Higbee lawyer Rayminh L Ngo. 

Here's the key takeaway.  Higbee is not looking to go to trial.  He wants a default judgment which happens when a defendant fails to answer a complaint and summons.  Other than that Higbee looks to settle and if you wait him out and show a willingness to proceed to the end the more he'll want to settle.

Look what defendant Bowling was willing to do and how she refused to buckle.  Getting sued is not the end of the world.  Answer the lawsuit, counter sue if necessary, and put up a fight.  This is exactly what Higbee doesn't want.  He wants the low hanging fruit.

Thank you Matthew for starting a dedicated thread for Higbee and Assoc.  This law firm, if it could be called that, deserves laser focus by ELI.  Sun light is the best disinfectant and that's exactly what Higbee deserves.

I had the same suspicion about Hamilton66.  I disagree the advice of the forum is reckless.  Farfrom it.  I also disagree with H's idea of contacting Higbee and making an arguement.  Save thatr for a judge if that were ever the case.  I would be very interested to hear from Mathew or any other of the senior posters comments on Hamilton66's post.

Higbee uses the court system to extract settlements.  That's it!  If he files one, the world won't end.  Answer it, push back, show no fear whatsoever.  He wants the easy fold.

I would say contacting Higbee is the best way for him to know that he got you nervous and would only encourage him to really mess with you more. 

Why put your self in that position?

You're not dealing with an honorable person, he's a bottom feeder looking for the quick cash.

It's true that Higbee is not a intellectual property lawyer.  His main business is criminal record exspongement.  And his firm has gotten bad reviews for that business.  As far as my research goes, he's never taken a copyright case to trial.  No way in the world does he want to go there.

Put the letter in a manila folder and do nothing.  Read the forum, a lot of good info here, get educated instead of getting panicked.  That deadline will pass and go until they send you another letter with a new deadline.
