Hello All,
I have read through many posts on the forum and pages on this site and want to first of all thank all of you for taking the time to share information and resources. Thanks!
My situation in brief: found a free template online and used it as a place holder for a domain name with literally no traffic. The only people who have ever seen the site are myself and Getty's robot. The intention was to put up a real website later.
Received a letter demanding a $1000 for the presence of one image in this template.
The image is in likely hundreds if not thousands of sites all over the net that use this same template. I have found many examples of the same template everywhere by just Googling the filler text that came with the template.
I compared the image in the template to the same image on Getty's website. The template takes the image and cuts it down by quite a bit then blends it with 2 other images to form a header image. Does this get any protection since it is a form of re-hasing or re-mixing of the original image (the same way remixed songs I believe are protected)?
I know even though it is a free template that won't help me much, but hopefully that fact that the site received zero traffic will.

Just a quick update for everyone, today I received a letter from the Ohio State Atty. Gen.'s office stating that they are still awaiting a response from Getty to my complaint with their office.
I wonder if Getty is going to send the same form letter response as they sent to all the other agencies I've complain to them about or if they are revamping it since they know I send a follow-up letter ripping them apart for not addressing the issues I brought up, a couple of out right lies and the major typos where they have my company name wrong as well as the amount they are claiming. I will let everyone know how Getty responds to this complaint.
I had incredibly busy weekend and was not able to get my packet together to send off to the Library of Congress's legislative Council that Stinger was able to provide but should have that finished up and off in the mail in just a few days and as always will make the letter as well as any responses available on my Scribd account.
I have a feeling you will hear nothing but crickets from them from this point on..they have to many other soft targets and low hanging fruit to take advantage of...

I've only read through the first document and it appears the photos they claim infringements for were filed in a bulk registration on one specific date, or at least that is how I read it.

at least you worked!! for like pay...this ELI habit of mine is getting expensive!I hate working late, look at all I missed today already!
It always burns me in these letters how they accuse you of manipulating the images to remove copyright information, watermarks or other identifying marks. While in almost every single case a simple search for the image will reveal it on free sites in multiple places. Hopefully people will start filing bar complaints for the language and tone of these letters much as they did to good old Timmy that made him change his ways and produce his new kinder gentler letter.
Greg, you're absolutely right. This is the most annoying part of the rote bluff because THEY CAN'T PROVE IT. They must know this unless they're totally deluded. They just throw that in because it sounds really scary that you could be nailed for a Federal crime, fined huge amounts of money, and thrown in jail.
Of course they fail to mention that the onus is on them to prove beyond reasonable doubt that the infringement was intentional. Proving intent in court is difficult and expensive and probably requires a more experienced IP lawyer than E.R.
