I wanted to give everyone a general heads-up to our readership of a "smear-shame" Squarespace blog "Voices of Jupiter FL" against Robert Krausankas, one of our friends and ELI team member.

Although Oscar and I best known for representing the cause on ELI, we have other notable members like Robert who have been a great friend and ally to the ELI cause. Robert (Buddhapi) has been part of ELI since 2009. He recently covered the Adlife Marketing / Joel Albrizio's $8,000 food image extortion since October. Robert's posts about them can be found here:

http://copyright-trolls.com/2.0/category/companies/adlife-marketing/
http://copyright-trolls.com/2.0/category/individuals/joel-albrizio/

Since October 2016, Robert has been threatened twice by Albrizio.  Once to "destroy" and "ruin" Robert's life: http://www.extortionletterinfo.com/forum/getty-images-letter-forum/joel-albrizio-(adlife)-allegedly-threatens-to-'destroy'-'ruin-life'-of-eli-membr/

Oscar Michelen wrote in response to those threats: http://copyright-trolls.com/2.0/adlife-marketing-joel-albrizio-gets-quick-law-lesson/

The 2nd time was to accuse Robert of copyright infringement because he shared and hot-linked a meme that was produced by someone else. http://www.extortionletterinfo.com/forum/getty-images-letter-forum/adlife-ceo-joel-albrizio's-attorney-daniel-shores-threatens-robert-over-meme/

Oscar Michelen, once again, set the record straight with Albrizio's lawyer: http://copyright-trolls.com/2.0/formal-response-to-latest-adlife-marketing-bullshit-letter/

Suddenly, out of nowhere a "Jessica Langston" who according to a FB page created on December 21, 2016 is a "stay-at-home parent" that goes out of "her" way to get Robert's attention through a FB message so that he can read "Voices of Jupiter Florida". The domain was registered on December 23, 2016. The first Squarespace post was made on December 22, 2016.  Purportedly, it is a group of "concerned parents and citizens" in Jupiter, FL whose purpose is to help clean up Jupiter, FL starting with Robert Krausankas and his blog, copyright-trolls.com. After all, in all of the city of Jupiter, Robert (website developer, website host, photographer, blogger, commentator, advocate) is the greatest threat to the citizens of Jupiter FL, right?

Some of the "eye-roll to the back of my head" accusations against Robert and how he is a horrible human being are:

1. He shared an image of a Rated-R image of a "porn troll" in this post:   http://copyright-trolls.com/2.0/porn-lawyers-indicted-on-criminal-charges-joel-albrizio-should-take-note/
It goes without saying it might make some people cringe but it is far from being true porn. People know true porn when they see it.

2. He sometimes uses an old photo that includes his daughter as a headshot photo. Somehow that is a horrible thing to do.

3. Robert sometimes uses 4-letter words and colorful language in his blog posts. ELI and copyright-trolls.com readers know that neither websites are catered to kids topics. We are discussing legal threats, legalized extortion, lawsuits, etc. It triggers very real anger, disgust, and other unpleasant emotions. And yes, 4-letter words and politically-incorrect rhetoric sometimes occur.

4. Supposedly, other "groups" in Washington State and Georgia are helping to "identify" other members associated with Robert. I don't suppose that those two "groups" might be Timmy McCormack (previously known as a Getty Images lawyer) and Linda Ellis (Dash Poet) both who were soundly trounced and embarrassed by the GA Supreme Court for trying to say I "stalked" Linda Elllis (when I never met or had any communications with her whatsoever).  http://www.extortionletterinfo.com/all-justices-concur-eli-wins-internet-free-speech-appeal-in-georgia-supreme-court/

5. April Brown, author of "Poetic Justice", mutual friend, critic of Dash Poet Linda Ellis, was also threatened by "Jessica Langston" for attempting to make a post in support of Robert. However, that post was blocked. Linda Ellis appears to have made a comment in support of that blog, but I am not sure if she has any idea if she knows who or what she is getting involved with given the anonymous nature of that website.

Good Afternoon April,

We have read and taken into consideration your e-mails we received this morning. While anyone can appreciate your loyalty and friendship with Robert we do not agree with any possibility of heroism associated with him...

Robert Krausankas is not a journalist but what appears to be an obsessive self destructive blogger. We have a short and long term goal with regards to Robert Krausankas.

Our best advice to you is...unplug your web site with regards to Linda Ellis and end all public humiliation of her.

Move on and enjoy your social life and active career.

While I personally make none of the go forward decisions, with the daily unfolding events both online and through public advertising vehicles it may be increasingly difficult to protect your reputation.

Even more difficult will be the task to defend yourself financially from what appears likely to be impending litigation.

Even Muhammad Ali was not wise enough to get out on top. Please consider this while time is on your side.

Jessica

6. An open attack was published against Robert (a FB message was sent to Robert into reading the blog):

Quote
As a group we are developing tremendous momentum in a very short time period. It is overwhelming how many of you came forward even before the development of the blog about the actions and behavior of Robert Krausankas.

Financially we have done well and have raised more than double the monies necessary to retain the law firm in the Lauderdale area to represent our group.

The attorneys have asked for the following information in the first request for information to determine possible financial awards to pursue from Robert Krausankas and any other individuals or companies involved.

1. Please provide copies of any image or document created by you or your company reproduced by Robert Krausankas without expressed written permission.

2. Especially important are and images or documents altered and posted on any web site or entity authored by Robert Krausankas or anyone associated with Robert Krausankas, Copyright Trolls or Extortion Letter.

3. Please provide examples of any of the previously mentioned documents or images presented through any advertising or social media channel with external distribution.

4. Any known sources of income of Robert Krausankas. This can be earned or passive income.

5. Any other persons, companies or web sites acting on behalf or in conjunction with Robert Krausankas in any effort to distribute false information, defamatory statements or documents or images protected by either copyrights or non disclosure language.

Our goal will be to seek financial damages and to seek sources available to secure those damage awards.

7. The blog is supposedly to be doing "good" for Jupiter but decides to run down Robert's wife and name his son in the post. This is mighty upstanding behavior by "Jessica Langston".

8, The blog's restated purpose is to "work tirelessly to expose ALL individuals involved with Copyright Trolls and allow you, the public to determine what your business or personal relationships with this group should be going forward."

Bottom line, we don't yet know definitively WHO the true owner or writer of the "blog" is so far. Due the coincidental timing of its sudden appearance and the going out of its way to inform Robert to read it, I suspect it is someone from Albrizio's camp. Or it could be Joel himself writing. Time will tell.

Generally speaking, when people choose to settle, it is done quietly.  And most settlement agreements call for the parties to NOT discuss it. Most people who settle, tend to fall off the grid.  Although, I do keep my ear to the ground and pickup some nuggets occasionally. I can tell you that anyone that settle close to the stated amount are generally very uninformed.

The small business that I work for has also received one of these letters, from Higbee and Associates. I posted the image after getting it from PicServer, failing to notice the "must attribute" part. Our lawyers have contacted Higbee and Associates and the minimum settlement they are willing to accept is $750. My boss is wanting to settle just to be done with it, as her lawyers are charging $350 an hour to deal with this. We offered to buy the image, (after immediately removing it).

Here are my questions: has anyone else dealing with this photographer and firm reached a settlement? If so, do you mind sharing what it is?

528
CList gets it.  Very good advice which we tell others.

Additionally, if you are reading this (and have received a letter) and are feeling overwhelmed :

  • Understand that you are not alone in this
  • Step back to gain perspective
  • Then take some time to read through the forums and use the search

The information contained in some of the threads on this site is golden.

You'll soon find that there are quite a few threads from people just like you that offer helpful suggestions and strategies.

The is very interesting about Recordgone.com.

It is also interesting watching his promo videos and the style they use. He is very obsessed with appearing "large" to the public although we at ELI know better that he uses virtual offices and rented addresses.

I'd like to see a copy of the Liebowtiz letter if you'd like to email it to me at matt30060 / gmail. This appears to be a new development.  All the other letters I have seen is from Higbee.

I received the same warning letter yesterday Dec 17, but it was coming from Liebowitz Law Firm in New York.

531
Nope, I have not seen any lawsuits by Nick Youngson yet. You are not alone, fortunately. I've consulted with a number of victims. As of right now, just a bunch of $5,000 letters over $10 images because of the Creative Commons mess.

Has anyone actually seen any suits filed by Mr. Youngson? I could not find any cases filed by Nick Youngson, NY Photographic and RM Media on any federal court.

I'm in the middle of a battle with Higbee and Youngson right now. Of course they state in writing they that have litigated numerous cases for Mr. Youngson.  Yeah right...

532
No, you are assuming they will sue. They may or may not sue. I have not seen any lawsuits filed by Nick Youngson or Higbee.  $5,000 is an arbitrary number on all of the recent Higbee letters I have seen.

But they will continue to pursue the matter by antagonizing you for the next 2-3 years.  You need to get educated on how extortion letters "work" so you are better prepared to deal with it. Otherwise, you will become a victim of ignorance. It gets expensive staying ignorant.

I just received a letter from Higbee & Associates representing Nick Youngson. They are demanding I pay $5000.00 in 10 days or they will sue. This is for one image on a test website for 60 days. I got the image from picserver and it said the image was free to use even commercially. So the image is free to use as is but there is a link to the full size image in which you can buy it for $9.95. How can an image go from free to $5000.00?

LCS typically doesn't sue from what we have seen. You can certainly ignore it and they will continue to pursue the domain owner/client. But most clients are not able to ignore it for the 3 years they will pursue the matter.  They will be upset with YOU. Oscar's program is used by many web designers who have fallen into this trap. Unless you pay them, they will continue to pursue your client. That is the reality. You will have to babysit your client through this or you can refer them to this forum so they can get educated.

I have been reading this site for the past 4 hours. I see that a lot, to "study up", but I guess I'm just not certain what it is I am actually looking for to study.  I have seen I can pay Oscar $200 and he will handle it. Has anyone ignored them and it just went away?

Collectively as a team and community, we have seen a lot but we are not infallible but we seem to do pretty good overall. It doesn't mean things can't change (and sometimes they do!).  We report on general patterns. We also have good instincts in filling in some of the holes.

If they are quiet with you now, it is more than likely they are off chasing other people who are new and lower-hanging fruit. There are thousands of letters out at any given time that are "active".

Oh, don't worry. Your case is still alive. If you want to call and settle with them, they will definitely speak with you! :-)

I think it's funny. People are upset when they get harassed with letters but you feel neglected and WANT to get letters to let you know if the case is active?  Trust me, it's active!

As promised, here is an update on this. I sent them a single email almost three months ago, and it has been deafening silence since. Is this normal? Kind of annoying, I would prefer they at least let me know if the case is still active or not. I will update the thread again if the contact me or when SOL passes.

BTW, you have all been great! Love the scrappiness of you folks.

536
Most photographers tend to shy away from the matter and push the issue to their "enforcers". Also, most photographers have signed agreements authorizing their agency to pursue such matters. However, there is no harm in trying to contact the photographer. There is very little to lose.

537
If Danny wants to run for Congress again and win, being connected to Joel Albrizio's effort to threaten and shut you down over a meme you never created or uploaded is not going to help his reputation. It is downright dumb.

It is embarrassing that a "patent" lawyer cannot even do a right-click on an image to verify its source. Moron.  But then again, that is what happens someone is foolish enough to follow Joel's supreme leadership and work "under" him.

Our own Robert Krausankas broke the story on copyright-trolls.com around Thanksgiving holidays about WebGrocer filing suit against Adlife Marketing for a declaratory judgment against their $8K letters over food photos against WebGrocer's clients.

I have not done an in-depth reading of the case but Robert has written a series of announcements, updates, and a preliminary analysis.

http://copyright-trolls.com/2.0/happy-thanksgiving-joel-m-albrizio-heres-another-lawsuit-just-you/

http://copyright-trolls.com/2.0/latest-an-greatest-lawsuit-naming-adlife-marketing-and-commnications-as-defendant/

http://copyright-trolls.com/2.0/adlife-marketing-communiationns-co-inc-gets-sued-again/

One can only assume Adlife Marketing CEO Joel Albrizio will have a bad week as he probably needs to spend some lawyer money to respond to this lawsuit.

Generally speaking, it costs very little except some paper, toner, envelope, and postage, for scummy guys like Joel to send their extortion letters out. However, it appears this time around, Joel might have to spend some money for being unreasonable to WebGrocer.

WebGrocer clearly is not taking this sitting down and letting a legal cloud hang over them. They decided to go on the offense and take the case to Joel Albrizio's company.

539
Once again, Adlife Marketing and Copyright Extortionist Crybaby CEO Joel Albrizio legally threatened our Robert Krausankas who also blogs on copyright-trolls.com. Robert has been reporting week after week on Joel Albrizio's various shenanigans and new nuggets of anonymous information keep appearing in his email inbox and text messages on his phone. It doesn't help that Joel made it personal by attacking Robert. After all, it is Joel who is running around threatening people with $8,000 demand letters.

One anonymous submission was a link to a meme of Joel Albrizio.  It is actually a fairly tame meme (I have seen far worse) which shows his photo from his LinkedIn page and some text. Examples can be found on the memegenerator.net website:

https://memegenerator.net/Joel-Albrizio

The meme crybaby Joel is getting all fussy about says, "Dresses Smartly, But Dumb A Fuck". Not entirely flattering but the half the meme's statement is actually a compliment. Someone thinks he "dresses smartly".  Whatever. Almost any guy looks good in a suit.

https://cdn.meme.am/cache/instances/folder78/500x/73445078.jpg

WE don't know who created the memes of Joel on memegenerator.net but he was apparently upset enough to contact "Patent" Attorney Daniel Shores (who had a failed run for Congress in his state) and sent a warning letter to Oscar Michelen, who is representing Robert and copyright-trolls.com, against legal threats by Joel against Robert.

http://copyright-trolls.com/2.0/copyright-trolls-need-thick-skin/

It accuses Robert of willful infringement. However, here's the deal. Robert never created the meme or uploaded the image to his website. He only hot-linked to the meme that resided on a different web server.  And supposedly, Attorney Daniel Shores is a respectable PATENT attorney but Danny is too DUMB and MORONIC to know, in which case he will get an embarrassing education from ELI that he could have easily right-clicked the meme to determine the meme's true source.

Ultimately, Oscar wrote a short response to Daniel Shores.

http://copyright-trolls.com/2.0/formal-response-to-latest-adlife-marketing-bullshit-letter/

Robert took the meme down because he really didn't have any vested interest in this very tame meme. Robert and I agreed that it wasn't worth the hassle and it would be more fun writing about it and telling everyone what a crybaby he was about that meme. And anyone can find and see the meme for themselves anyhow since it is out on the Internet.

My question to Danny-boy Shores is, how does he feel to be representing and being connected to a copyright extortionist who appears to have a sordid past? Given their attorney-client relationship, maybe Danny-boy needs to have some one-on-one time with Jackass Joel and find out about all the little secrets (tabloid sleaze type of stuff) Joel wants hidden from the public. So now, Google will now show that Daniel Shores represented Joel Albrizio to threaten Robert over a meme he never created or uploaded. How dumb is that? How much did Danny-boy get for that dumb assignment?

I don't have any dog in the fight regarding Joel.  But as long as he keeps on with his $8K extortion letters and Robert keeps telling me stuff about him and ESPECIALLY threaten him, it is hard for me to stay quiet.

No one is telling you to respond to every ass-hat.  If you are taking it that way, you still don't get it and this will be my last reply to you on the matter. I am telling people to think critically using well-documented stories and information on this forum.

You very much believed a flawed analogy. It isn't hard to verify the owner or landlord of a house.  It is clearly shown and proven in public record deeds.

Images, ownership, and the copyright registration matter are not so clear.  There is uncertainty. And you are not receiving a letter from a Nigerian scammer. You are receiving a letter from a well-known media company who is also known for sending these legal demand letters.

If you choose not to respond because it was a de-minimus or severe infringement, that is one thing. But it makes no sense to me to not respond if you think you are clearly in the right. If you don't mind getting the ongoing letters and the remote possibility of a lawsuit, then you can stay silent and NOT explain it. To me, it costs very little to write an informed letter vs. staying in the dark.

Having said all that, everyone's case is their own.  But expect to be notified periodically for the next 3 years. For some, it's no biggie. For others, it is a mental distraction and cloud over them for a long period of time.

None of us have a dog in your fight with Getty.  But many of us happen to be very experienced at this sort of stuff of pushing back and defending one's self.

And why I waited so long to respond: Maybe my reasoning is flawed, but a poster used the analogy on this forum of owning a house and receiving a letter for rent due from someone claiming they own your house. Do you really need to respond to every ass-hat claiming you owe them rent on something that is blatantly false? Apparently yes....
