Thank you for the kind words and I couldn't agree with you more.  I do believe in the rights of the artist and that they should get paid for their work but I also feel Getty and MF should ask for a reasonable settlement amount, and that a request for proof of claim is more than reasonable when the letter recipient is being presented with such a large figure.  Getty responding to a letter recipients request of we only provide this information during discovery or in other words when we sue you is totally unacceptable.

Greg - I'll definitely post updates to my tale as it progresses.  I want to thank you especially for all that you're doing.  It has become evident to me that in order to effect change, enough people must stand up to the trolls, and regulators and lawmakers must be made aware of their unethical business practices.  The fact that AG offices and State Bar Associations are now being forced to pay attention and get involved is testament to that.  If nobody stood up and complained, nothing would change.

I would also add this definition of "Extortion" from the Wiki page on the subject:

The term extortion is often used metaphorically to refer to usury or to price-gouging, though neither is legally considered extortion. It is also often used loosely to refer to everyday situations where one person feels indebted against their will, to another, in order to receive an essential service or avoid legal consequences.

I myself have often longed to act metaphorically and this site has given me that ability. Thank you ELI!

thank you for sharing your story and I am glad to see that you ware willing to fight until MasterFail provides you with the proof of claim that was reasonably requested.

Whether you are cordial, short or neutral, Getty doesn't care it is all about the money with them.  They do not however like the complaint letters and will generally end up leaving you alone if you file enough of them.  The last letter I received from Getty was the one stating they were escalating to their legal department which caused me to launch my campaign which I told them would happen if they did not either send me the proof requested or drop their claim.  After filing complaints with the Attorney General's Office, the BBB, the FTC my Congressman and Senator they spent about a month and a half answering one complaint after another I never heard another word from them.

Do not threaten to do this unless 1) You feel the letter or the way Getty is handeling it is misguided and misdirected and should be reported.  2) You intend to follow through with it, if you say you are going to do it and don't Getty won't believe you and will continue to harass you

I agree with Robert,and let them know if they contact you again you will file complaints against them what the Washington state attorney general's office, the Better Business Bureau and the FTC.

Just to clarify the WSBA letter is the Washington State Bar Association and was not from the Washington State Attorney Generals office.  The letter reciepient filed complaints with the AG's Office as well as the WSBA and included a copy of the response from the WSBA along with his complaint to the AG.  Mr. McCormack might blow off the AG's office with boilerplate letters but I doubt he would do so with the WSBA as they are much quicker to action.

Looking at the running totals on the complaints now, and we are only half way through receiving them, I plan to send a letter to the AG's office once I have them all asking what is the tipping point for them to start to investigate and act. 

The grand total on complaints right now stands at 84 complaints filed with the AG's office, and 96 complaints with the BBB.

We'll have a more complete report soon from Ken "Popehat" White, who was in the courtroom for the Prenda hearing today and will be writing about it for us (and for his own site), but for the quick version of what happened, with a huge assist from both Adam Steinbaugh and White, is that the judge has not made a ruling yet, but he is not at all pleased, saying "the client has been running everything. I know who the client is." There was no direct admission of who owns AF Holdings (other than that it had been transferred to another holding company, LiveWire -- as Pietz pointed out in his chart), but nothing else directly came out in court, apparently, other than Judge Wright's claim that he knows what's going on. In fact, he noted that the shell companies are "not even shells." This does not bode well for Prenda.

Look closely at complaint #22.  Here is our first look at a response to a complaint from the Washington State Bar Association about Mr. McCormack.  It looks as if they are telling Mr. McCormack he must provide all the proof that the letter recipient has asked for to them for review, mark anything confidential as they were going to forward it to the complainant minus the confidential stuff.  I imagine the contributor agreement would not be forwarded.  I find it of interest that the Bar Association requires this information to see if the Getty/McCormack claim of infringement is valid yet Getty/McCormack expects us to blindly pay when they refuse the same requests for proof from us.  Getty v. Advernet, just sayin…….

Just for me personally, I realized how this correspondence would go for the most part, I also know there was pretty much 0 chance of them taking me to court but I decided that I would start off my letters friendly and let Getty be the ones to not cooperate so in the extremely unlikely event I did end up in court I can show that I tried to work with them. 

If you read my letters you will notice that with each reply and refusal from Getty to cooperate with my reasonable requests I became more forceful until my final letter when I told them drop the claim or I will launch a complaint letter campaign.
