The image in question could also have been seeded onto sites to encourage infringement.  I've successfully gotten a photographer to back off by accusing him and his attorney of purposefully spreading the image in question around the internet to cash in on it.  The photographer was a struggling rather unsuccessful one so it was plausible this was his only method to make money on his subpar images.

It breaks down the entire system as well as its participants.

I find it funny that the article tries to remain even keeled yet paints Higbee's firm as anything but a copyright troll.   ::)

The bottom line is that the copyright laws need to catch up to the times so that these Extortion letter mills (and their participants) are put out of business.

I can see this backfiring big time...

All it takes is this ending up in front of the wrong judge and *poof* the jig is up.

From what I've read, the courts (and Judges) do not like to entertain these types of "business endeavors"..

Me thinks it may have happened around the time that He decided to pursue litigation under the RM media umbrella.

Probably motivated by a few words from here or his "legal expungement specialist" representation...  ;)

Again, I have no problem at all with people who genuinely want to protect their intellectual property.

That said, that's not whats going on here.

What we have here are scumbags running a legal extortion business by exploiting people's ignorance about the Creative Commons license though a loophole in the system. 

They and their legal representation are garbage people.

Straight up.

Very interesting indeed. It looks like the disgusting Nick Youngson Honey Pot scheme will continue to expand and ensnare more victims.


..I recently visited one of his websites and immediately noticed that it had been "updated" and now displays the attribution requirement at the top of the page...  :o

While this change will probably mean less bees being trapped in the honeypot, as long as his images are still ranking in Google for "Creative commons images", there will be more victims...

In the interest of fairness, my comments inline...

Multiple red flags here.

I'd stay away from that site.

- Wordpress theme
(We have a Wordpress component to ELI which consists of mostly static content.)

- Generic stock homepage image

- Multiple hyphens in the domain (done strictly for SEO purposes)

- No contact info
(Yes, that is a red flag.  I don't like contact forms when you have no idea who is behind the website.)

- No business info
(Yes, I agree with this as well. Victims are going to entrust their case information to an unknown individual or company?)

- http not https
(Our Wordpress side is https compliant.  We are working on getting the forums on https compliant "soon".)

And the list goes on..

IMO its just a POS opportunist site with data compiled from here (possibly) looking for the quick cash grab.

Again: Stay away.

Read this site and save yourself from getting ripped twice.
(Thank you for saying that. I am biased but I think we are very open and transparent in the information we provide and what/why we do what we do.)

Didn't mean to bash WordPress ~ to clarify, WordPress sites are relatively easy to set up if you know what you are doing... And that setup looks like a theme that was just "slapped together" in my opinion...

I'm not surprised by this as 420 Evaluations is located in Higgy's, I mean higbee's backyard.. Making them the lowest hanging fruit on the tree...

I smell a settlement in the air... or is it something else...?   :o

I had the same suspicion about Hamilton66.  I disagree the advice of the forum is reckless.  Farfrom it.  I also disagree with H's idea of contacting Higbee and making an arguement.  Save thatr for a judge if that were ever the case.  I would be very interested to hear from Mathew or any other of the senior posters comments on Hamilton66's post. 

Yeah. His post seemed very troll "ish".   ;)

Additionally, I've read countless threads on ELI and have spoken to IP and Copyright attorneys and a lot of the statements made on this site were supported.  So I'm calling BS on the "reckless" statement as well.

With that said, I do believe that everyone's situation is different and because of this there is no "1 size fits all" solution. That's why its so important for everyone to take what they read on this site with a grain of salt and do their own due diligence to build and strengthen their case. 

Because at the end of the day, if you've been contacted by a troll ~ you need to get educated so you don't become another victim.

Simply email them and tell them you have no money and ask them to explain how your review of a book that used the image of a book (or from the book) is not fair use.

 If you have no money or there is a fair use defense, which there probably is if the image is of the book (as you mentioned above) or from the book, let them know.  The sooner the better as it will relieve your stress and they will likely drop the case if you are correct or even close to correct... 



Again, you sound like you work for Higbee....and with 1 post in your corner....  ???

The fact that this was stated in the settlement letter tells me that all that was accomplished in this extortion attempt was both parties losing money..

Part of me cant help but wonder if the Higbee Extortion crew is exploiting their clients by providing misleading scenarios which entail taking these cases on initially with the "personal injury lawyer" marketing ploy and then either bailing when it gets pricey or rolling over the actual costs onto the client when things get expensive.
